Terms for software, Managed hosting, the customer portal, licences, updates and support. These terms are made available before ordering in a form that can be saved and printed.

Scope and definitions

These Terms cover the website, customer portal, PBX software, applications, updates, licences, documentation, support and RelayPBX Cloud, RelayPBX Dedicated Cloud and Self-hosted deployment. A Tenant is a logically isolated organisation. A Plan is the edition, capacity, modules, deployment and support recorded in an order. Communications Data includes call metadata, recordings, voicemail, FAX, chat, PCAP and diagnostics.

RelayPBX does not supply SIP carrier service or telephone numbers. The Customer contracts with and maintains its chosen carrier.

Electronic services and technical requirements

Free electronic services include the website, documentation, account, portal and forms. Paid services include licences, hosting, capacity and support stated in the order. An up-to-date browser, Internet access, an active email address and compatible equipment are required. Self-hosted operation also requires a supported Linux host, Docker, and public DNS and TLS when exposed to the Internet.

Customers must not submit unlawful content and may end a free service by signing out or requesting account deletion, subject to legal and contractual retention.

Account and security

The Customer must provide accurate data, protect credentials, use MFA where available and promptly report compromise. Properly authenticated activity is attributed to the Customer unless compromise was previously reported. Roles must follow least privilege.

Orders and contract formation

The configurator creates a quote and does not itself charge the Customer. Before payment, RelayPBX shows the Plan, price, currency, cycle, applicable tax treatment, contractual documents and the consequence of ordering. A paid contract forms when the Customer uses an unambiguous payment-obligation control and payment is confirmed, or when RelayPBX accepts an individual order.

RelayPBX records the account email, buyer identity, document versions and acceptance time. A sales-review quote is not accepted until RelayPBX confirms it in writing.

Prices, tax, invoices and renewals

The order and Commercial Policy define price and limits. PLN prices on relaypbx.pl are gross and include 23% Polish VAT unless checkout shows different treatment based on buyer status or location. EUR catalogue prices exclude tax. The Customer is responsible for accurate billing and tax data.

Subscriptions renew for their chosen cycle until canceled. Future price changes are notified in advance. Failed payment starts the published grace period, after which paid features or a RelayPBX Cloud environment may be suspended without tearing down active calls.

Trial, cancellation, refunds and plan changes

The Commercial Policy defines trial, voluntary refund, upgrade, downgrade and grace rules. Voluntary rights do not restrict statutory rights. Paid upgrades may apply immediately after confirmation with proration; downgrades normally apply at renewal.

Complaints may be sent to support@relaypbx.com with an account or order identifier, description and requested resolution. Consumer complaints are answered within the legally required period.

Consumers and withdrawal

An eligible consumer contracting online may withdraw without reason within 14 days, subject to statutory exceptions. Starting earlier requires a separate express request. Withdrawal after requested commencement may require a proportionate payment. The right may end after full service performance or commencement of digital supply after the required acknowledgements.

Licence and intellectual property

RelayPBX proprietary components are protected by copyright. The Customer receives a limited, non-exclusive, non-transferable right to use them within the active edition, limits, deployment and LICENSE. Community is Self-hosted only. Service-provider use, resale, white-label and multi-customer operation require an appropriate edition.

Licence circumvention, credential sharing, unauthorised redistribution and removal of legal notices are prohibited. Restrictions on analysis apply only to the extent permitted by mandatory law. Third-party components retain their own licences and notices.

Telephony, emergency calling and Customer duties

The Customer configures the carrier, numbers, routing, caller presentation, emergency location and local legal compliance. RelayPBX does not guarantee emergency calling unless it has been correctly ordered, configured and tested with the carrier. RelayPBX must not be the only means of emergency communication available to the Customer.

The Customer is responsible for lawful Caller ID, PAI, Diversion, X-Headers, campaigns, recording and traffic generated by its users. The AUP applies.

Recordings, FAX, PCAP and Communications Data

Capture features do not create a legal basis. The Customer determines purpose, legal basis, scope, retention, notices and access. Call Capture is disabled by default and requires a separate module, role and configuration. See the Communications Data Policy.

Personal data and processing

RelayPBX is controller for account, sales, security and support data under the Privacy Notice. For Communications Data processed on behalf of the Customer, the Customer is controller and RelayPBX is processor under the DPA. The Customer provides the lawful basis and notices to its users and callers.

Availability, support, updates and changes

Support scope and response targets follow the Plan. Version 1.0 uses portal and email during published hours and does not promise telephone or human 24/7 support. SLA targets are not guaranteed permanent-fix times.

RelayPBX may apply security fixes and changes needed for service integrity. Material planned maintenance is notified in advance where practicable. Self-hosted deployments must remain on a supported version. Beta features have no production SLA.

Suspension, termination and export

RelayPBX may restrict service for non-payment, security risk, unlawful use, licence excess or material breach. Where risk permits, notice and a cure period come first. Immediate isolation is permitted to protect users, infrastructure or legal compliance.

The Customer may cancel renewal in the portal or through support and should export data before termination. Data is returned or deleted under the DPA, retention policy, backup cycle and legal duties.

Liability

RelayPBX provides the service professionally and as ordered but cannot guarantee the Internet, a SIP carrier, Customer equipment or third-party services. Nothing excludes liability that mandatory law does not permit to be excluded or any statutory consumer right.

For B2B Customers, to the extent lawful, aggregate annual liability is capped at net fees paid for the affected service in the preceding 12 months. RelayPBX excludes lost profit, revenue and indirect loss except for intentional misconduct and other non-excludable cases. Self-hosted Customers maintain continuity procedures and backups.

Law, disputes and changes

Polish law governs. B2B disputes are submitted to courts competent for the registered office of the provider unless mandatory law says otherwise. Consumers retain mandatory protection and jurisdiction of their habitual residence. The complaint process should be used first.

RelayPBX may change these Terms for law, security, functionality, supplier or commercial reasons. Material changes to active paid contracts are notified in advance on a durable medium. Each order records the accepted version.
